Employer Terms of Service
1. Scope
These Employer Terms apply to hospitals, clinics, healthcare organisations, recruitment agencies, telemedicine providers, medical device companies and fellowship providers (“Employers”) using EMERGE.Hire and related tools. They supplement the general Terms of Service and Privacy Policy; in conflict, these Employer Terms prevail for Employer accounts.
EMERGE ("EMERGE", "we", "us", "our") is an early-stage technology platform operated by its founder in India. EMERGE is currently pre-incorporation; these terms will be assigned to the registered entity upon incorporation, and this page will be updated accordingly.
2. Truthful postings
- Every job or fellowship posting must describe a real, currently open position at the named organisation.
- Fake jobs, bait postings, talent-pool-building listings disguised as jobs, and duplicate spam are prohibited and will be removed.
- Postings must accurately state the role, designation, location, duty pattern and requirements.
- Expired or filled positions must be closed promptly.
3. Salary transparency & compensation honesty
- Stated compensation must be genuine and achievable; misleading compensation (inflated ranges, hidden deductions, undisclosed bond obligations) is prohibited.
- Bond/service-agreement requirements, if any, must be disclosed in the posting.
- EMERGE may display market benchmarks (DMFPI) alongside postings.
4. Candidate privacy obligations
- Candidate data (profiles, CVs, applications, messages) may be used only to evaluate candidates for the posted role.
- No selling, sharing, scraping, or exporting of candidate data to third parties or databases.
- Delete candidate data when no longer needed for the recruitment purpose.
- Contact candidates professionally; no unsolicited marketing.
5. Non-discrimination
Employers must comply with applicable Indian law and must not discriminate in postings or hiring on grounds such as religion, caste, sex, place of birth, or disability, except where a bona fide occupational requirement is lawfully permitted. Discriminatory postings will be removed.
6. Fraud prevention & verification
- EMERGE may verify organisation identity (website, official email domain, registration documents) and may display or withhold verification badges at its discretion.
- No fees may be charged to candidates for applying, interviewing, or being placed.
- Suspected fraud leads to immediate suspension and may be reported to authorities.
7. Legal compliance
Employers are solely responsible for compliance with all applicable employment, labour, immigration and professional-registration laws in every jurisdiction they hire for, including lawful contracts, working hours, and statutory benefits.
8. EMERGE’s role & liability
- EMERGE is a technology platform, not the employer, not a recruitment agency, and not a party to any employment contract formed.
- EMERGE does not guarantee candidate availability, quality, credentials, or hiring outcomes.
- Employers are responsible for their own screening and credential checks before hiring.
- The Limitation of Liability in the Terms of Service applies fully.
9. Termination
EMERGE may suspend or terminate Employer accounts and remove postings at its sole discretion for breach of these terms, fraud, candidate complaints, or legal risk — with or without notice. Employers may close their account at any time; active postings are unpublished.
